The court ruled that it was unconstitutional for Governor Fubara to have presented an appropriation bill before a four-man House of Assembly, thereby depriving twenty-eight constituencies of proper representation.
The court emphasized that this act violated an earlier court order instructing him to re-present the 2024 appropriation bill before a duly constituted Assembly under Amaewhule’s leadership.
Furthermore, the apex court condemned Governor Fubara’s actions regarding the alleged defection of twenty-eight members of the Rivers Assembly, describing it as an act of lawlessness and dictatorship aimed at preventing the House from fulfilling its legislative duties under the speakership of Amaewhule.
